Terms of use

This is a translation for convenience. The German version is the legally binding one.

1. Scope

These terms govern your use of koi.photo (the web app, its documentation and cloud features), operated by Bennett Hollstein (see the Impressum). Users' own terms do not apply.

2. The service

koi.photo is a free photo and vector editor that runs in your browser. Without an account it works entirely on your device. A free account lets you save documents to the cloud (currently up to 1 GB), create share links and edit together. There is no entitlement to any particular availability or to any feature staying available. We may change, limit or discontinue features; we will tell registered users in good time before cloud features are significantly reduced so you can download your files.

3. Accounts

You must be at least 16, or have a parent's or guardian's consent, to create an account. You sign in with a link sent to your email address (or with Google/GitHub where offered); keep access to your mailbox safe. People who open a share link can join as a guest without an account.

4. Your content

You keep all rights to your images, documents and other content. So that we can run the cloud features, you grant us a non-exclusive, royalty-free, worldwide licence to store, copy and technically process your content (for example to make thumbnails) and to make it available to the people you share it with by link, including the preview card shown when a link is shared in a messenger. This licence exists only to operate the service and ends when you delete the content or your account (backups are overwritten on their normal cycle). We do not use your content to train AI models and we do not sell it.

You confirm that you hold the rights needed for your content, including for images of people, and you are responsible for what you share.

5. Acceptable use

In particular, you may not:

store or share unlawful content, including child sexual abuse material, content glorifying violence or inciting hatred, or content that infringes others' rights (copyright, trademarks, personality rights);
create or spread deceptive depictions of real people (deepfakes) without their consent;
disrupt the service, circumvent security measures, quotas or rate limits, create accounts in bulk by automated means, or distribute malware;
use share links or storage as general file hosting for third parties.

We may block or remove content and suspend accounts that break these rules. Report unlawful content to [email protected]; we review reports promptly (Art. 16 DSA).

6. AI features

Local AI (Select Subject, Remove Background, Object Select) runs on your device; your image never leaves it.

Cloud AI (Generative Fill, Generative Expand, AI Remove, the assistant) is not enabled yet. Once it is, it will be available to signed-in users within a monthly quota. It sends image crops, masks and text prompts to AI providers (details in the privacy policy). AI output can be wrong, unexpected or similar to existing works; check it before you use it. You are responsible for how you use the output, including labelling it as AI-generated where required. The usage policies of the model providers (among them Black Forest Labs, Google and the provider of the assistant model) also apply; requests that break them are refused. Quotas and available models may change.

7. Liability

The service is free of charge. We are liable without limitation for intent and gross negligence, for injury to life, body or health, and under the German Product Liability Act. Otherwise liability is excluded as far as the law allows. For defects we are liable only if we fraudulently concealed them. Please keep copies of important files (for example with "Download all files").

8. Termination and deletion

You can delete your account at any time in the account settings; your cloud files are deleted with it. We may end your use of the service with two weeks' notice by email, or immediately for serious breaches of these terms. Guest sessions without an account are removed automatically after a period of inactivity (see the privacy policy).

9. Changes

We may change these terms for a valid reason (for example new features or changes in the law). We will email registered users at least 30 days before a change takes effect. If you do not agree, you can delete your account before then.

10. Final provisions

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers this applies only insofar as it does not override mandatory consumer protection law of the country where they habitually reside. If you are a merchant, the place of jurisdiction is the operator's seat. If any provision is invalid, the rest remains in effect.
